Terms of Service
Effective date: 28 March 2026
1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Sesame mobile application and website (together, the "Service"), operated by Sesame ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and add an entry to the changelog at the bottom. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
2. Description of the Service
Sesame is a digital property passport that gives homeowners a single place to manage everything about where they live. The Service includes:
- Property records: Store and organise property details including address, physical characteristics, construction data, energy ratings, cadastral references, and ownership history.
- Document management: Upload, categorise, and store property-related documents such as receipts, invoices, certificates, manuals, and photos.
- Document scanning: Extract data from receipts and invoices using on-device optical character recognition (Apple Vision).
- Financial tracking: Record and monitor mortgages, insurance policies, property valuations, and utility bills.
- AI concierge: Ask questions about your property and receive answers powered by artificial intelligence (Anthropic Claude API).
- Utility analysis: Analyse utility bills against regional benchmarks to identify potential savings.
- Property enrichment: Automatically populate property data from government registries in supported countries.
- Maintenance scheduling: Create and track maintenance tasks and reminders.
- Project management: Plan renovation projects, track budgets, manage suppliers, and store project documents.
- Collaboration: Share property access with family members, tenants, or professionals with role-based permissions.
- Data export: Export your property passport in a structured format aligned with the EU Digital Building Logbook framework.
3. Eligibility
You must be at least 16 years old to use the Service. By using Sesame, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Your account
To use the Service you must create an account using Apple Sign-In, Google Sign-In, or an email address and password. You are responsible for:
- Maintaining the security and confidentiality of your account credentials.
- All activity that occurs under your account.
- Providing accurate and complete information when creating and maintaining your account.
- Notifying us promptly if you believe your account has been compromised.
You may not create multiple accounts for the same person, share your account credentials with others, or use another person's account without their permission.
5. Your content
You retain full ownership of all content you upload to Sesame, including documents, images, property information, financial records, and any other data you provide ("User Content").
By using the Service, you grant us a limited, non-exclusive, worldwide licence to process, store, and display your User Content solely for the purpose of providing and improving the Service. This licence ends when you delete your content or your account.
Content responsibilities
You are solely responsible for your User Content. You represent and warrant that:
- You have the right to upload and share the content you provide.
- Your content does not infringe the intellectual property rights, privacy rights, or other rights of any third party.
- Your content does not contain malicious software, viruses, or harmful code.
- Your content is accurate to the best of your knowledge, particularly where it relates to property details and financial information.
Document visibility
When you upload a document, you choose its visibility scope. Documents marked as "property" are visible to all members of that property. Documents marked as "private" are visible only to you, regardless of who else has access to the property. You are responsible for setting the appropriate visibility for your documents.
6. AI-powered features
Sesame includes features powered by artificial intelligence, including the chat concierge and utility bill analysis. When you use these features:
- Relevant property context (including property details, financial records, project data, and supplier information) is sent to the Anthropic Claude API for processing.
- AI responses are generated automatically and may contain inaccuracies. They are provided for informational purposes only and do not constitute professional, legal, financial, or technical advice.
- You should independently verify any information, recommendations, or analysis provided by the AI before making decisions based on it.
- AI-generated insurance claim drafts, cost comparisons, and benchmark analyses are indicative only. You are responsible for reviewing and confirming any correspondence or actions before proceeding.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
7. Property data and enrichment
When you add a property, Sesame may automatically query government property registries in supported countries to populate available data such as building dimensions, construction year, energy ratings, and tax valuations. This data is retrieved from public records and is provided as-is. We do not guarantee its accuracy or completeness.
You may override any automatically populated data with your own information. Your manually entered data always takes priority over registry data.
Property data enrichment is available in supported countries only. The availability and completeness of registry data varies by jurisdiction.
8. Sharing and collaboration
You may invite other people to access a property by assigning them one of the following roles:
- Owner: Full access to property data. Can manage members, add documents, and transfer ownership.
- Tenant: Can view property data and add documents.
- Guest: Read-only access to property-scoped data.
When you share a property, only data with "property" visibility is shared. Documents and financial records marked as "private" remain visible only to the person who created them.
You are responsible for managing who has access to your property and at what permission level. We are not responsible for any actions taken by users you have invited.
Ownership transfer
If you transfer ownership of a property to another user, property-scoped data (including documents marked as "property") transfers with it. Your private documents and financial records remain yours and are not transferred.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to access another user's account or data without authorisation.
- Upload malicious content, viruses, or any code designed to disrupt the Service.
- Reverse-engineer, decompile, or attempt to extract the source code of the application.
- Use automated tools, bots, or scrapers to access the Service without our prior written consent.
- Circumvent, disable, or interfere with any security features of the Service, including Row-Level Security controls.
- Use the AI features to generate harmful, misleading, or illegal content.
- Misrepresent your identity, property ownership, or any information you provide.
- Use the Service in a way that could damage, disable, or impair it for other users.
10. Intellectual property
The Sesame application, website, design, code, logos, and all associated intellectual property are owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in our intellectual property except the limited right to use the Service as described here.
The EU Digital Building Logbook export format is based on the European Commission's open framework and is not proprietary to Sesame.
11. Data export and portability
You may export your property data at any time in a structured format aligned with the EU Digital Building Logbook framework. Exported data includes property identification, building structure, energy performance, maintenance schedules, and ownership history. Financial data is included only for active property owners. User identifiers are anonymised in all exports.
Private documents (such as invoices and receipts) are not included in exports. Document metadata may be included.
12. Account termination
Termination by you
You may delete your account at any time from within the app. When you delete your account:
- Your profile information (name, email, phone number) is permanently erased.
- Your profile photo is deleted from storage.
- You are removed from all shared properties.
- Your private documents are removed.
- Your authentication record is deleted.
- An anonymised record is retained only for database referential integrity.
If you have an active paid subscription at the time of deletion, your subscription will be cancelled immediately. Apple's standard refund policy applies; we do not issue pro-rata refunds for unused time in the current billing period.
We recommend exporting your property data before deleting your account.
Termination by us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent or harmful activity, or if we are required to do so by law. Where possible, we will provide notice before suspension or termination.
13. Third-party services
The Service integrates with third-party services to provide its functionality. These include:
- Anthropic (Claude API): AI chat and utility bill analysis.
- Supabase: Backend database, file storage, and authentication.
- Google Maps: Property location display.
- Apple and Google: Authentication providers.
- Government property registries: Property data enrichment across supported countries.
Your use of the Service is also subject to the terms and policies of these third-party providers. We are not responsible for the availability, accuracy, or practices of third-party services.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the above, we do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Data retrieved from government registries is accurate, complete, or current.
- AI-generated content is accurate, reliable, or suitable for any particular purpose.
- Utility bill benchmarks, mortgage comparisons, or insurance analyses reflect current market conditions.
- The Service will meet your specific requirements.
15. Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim, or fifty euros (€50), whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
16. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of a third party.
17. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the European Union and the applicable laws of the jurisdiction in which we are established. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
If you are a consumer in the European Union, you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.
18. General provisions
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sesame regarding the Service.
19. Subscriptions and billing
Sesame is free to use. You do not need a paid subscription to store documents, track maintenance, manage projects, record financial history, or use any core feature of the Service.
Paid subscriptions unlock two things:
- More AI queries: The Free plan includes 25 AI queries per month. The Home and Home+ plans provide unlimited queries.
- Multiple properties: The Free plan supports one property. The Home+ plan allows you to manage multiple properties with full owner access.
Each plan also includes a document storage allowance:
- Free: 250 MB
- Home: 500 MB
- Home+: 2 GB
Storage limits apply to uploaded documents and files only. Structured property data (records, logs, history) does not count toward your storage allowance.
Billing and payment
Paid subscriptions are processed through Apple's in-app purchase system. By subscribing, you agree to Apple's payment terms. We do not process or store your payment details directly.
Subscriptions are billed monthly or annually depending on the option you select at checkout. Annual plans are charged as a single payment at the start of each billing year.
Auto-renewal
Subscriptions auto-renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription in your device's App Store settings.
Cancellation
You may cancel at any time. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that date.
What happens when you downgrade or your subscription expires
If your subscription expires or you downgrade to the Free plan:
- AI queries: Your monthly limit reverts to 25. AI queries are only available for your primary property.
- Additional properties: You retain Guest access to any properties beyond your primary one — you can view data but cannot add projects, documents, or use the AI concierge for those properties.
No data is deleted immediately as a result of a downgrade or cancellation.
Document storage retention
When a paid subscription ends — whether through cancellation, downgrade, or account inactivity — your uploaded documents and files are retained for 45 days. If you reactivate a paid plan within that period, your documents are fully restored. After 45 days, documents associated with the lapsed plan are permanently deleted.
This retention period applies to uploaded files only. Structured property data (records, logs, history entries) is not subject to deletion on downgrade and remains accessible on the Free plan.
Refunds
Subscription payments are processed by Apple and are subject to Apple's refund policy. We do not issue refunds directly. For refund requests, please contact Apple Support through your App Store account settings.
Price changes
We may update subscription prices from time to time. We will provide at least 30 days' notice before a price increase takes effect at your next renewal. Continued use of a paid subscription after a price change constitutes acceptance of the new price.
